1.1. This terms of use (together with the documents referred to in it) tells you the terms of use on which you may make use of our website www.springpod.co.uk (our Site), whether as a guest or a registered user. Use of our site includes accessing, browsing, or registering to use our site.

1.2. Please read these terms of use carefully before you start to use our site, as these will apply to your use of our site. We recommend that you print a copy of this for future reference.

1.3. By using our site, you confirm that you accept these terms of use and that you agree to comply with them.

1.4. If you do not agree to these terms of use, you must not use our site.

2.1. These terms of use refer to the following additional terms, which also apply to your use of our site:

2.1.1. Our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using our site, you consent to such processing and you warrant that all data provided by you is accurate.

2.1.2. Our Acceptable Use Policy, which sets out the permitted uses and prohibited uses of our site. When using our site, you must comply with this Acceptable Use Policy.

2.1.3. Our Cookie Policy, which sets out information about the cookies on our site.

2.2. Experience means and includes: any and all work experience, apprenticeships, employment, online mentoring, career and educational exploration, and advice services.

3.1. www.springpod.co.uk is a site operated by The Education Hub Group Ltd (‘We’ or ‘Us’). We are registered in England and Wales under company number 10198170 and have our registered office at 71-75, Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ. Our main trading address is 16 Cole Street, London, SE1 4YH

4.1. We may revise these terms of use at any time by amending this page.

4.2. Please check this page from time to time to take notice of any changes we made, as they are binding on you.

5. Changes to our site

We take your individual rights very seriously. Your rights, and how we uphold them, are explained below:

You have the right to be informed when we collect data

  • Comprehensive details of the data that we collect is included in this Policy and summaries are prominently displayed throughout Springpod.

You have the right of access to your data

  • The data Springpod collects to give you the best experience possible is yours. You have the right to request it whenever you want. Please submit a request to our DPO, Sam Hyams, by emailing dpo@springpod.co.uk. Once a request is received, we will send you your data within 2 working days. There is no charge for this service.

You have the right to change any incorrect data

All personal data we process can be rectified if inaccurate or incomplete. This can be done by editing your data directly on Springpod or by contacting the DPO, Sam Hyams, by emailing dpo@springpod.co.uk who will complete within 5 working days from the request.

You have the right to be forgotten

You can request that all of your data is permanently deleted. This can be done by contacting the DPO, Sam Hyams, by emailing dpo@springpod.co.uk who will complete within 5 working days from the request.

You have the right to prevent Springpod processing your data

If a user wants to restrict us from processing your data, you can do this by contacting the DPO, Sam Hyams, by emailing dpo@springpod.co.uk who will complete within 5 working days. Once this is done, you will not be able to use your account as we will not be able to process your data. The data will be transferred to a secondary database in case you want to reactivate your account in the future and will be deleted permanently 6 years from your last login.

You have the right to move your data

If you want to move your data for any reason, you can request your data in a CSV format by contacting the DPO, Sam Hyams, by emailing dpo@springpod.co.uk who will complete within 5 working days.

You have the right to object to profiling

If you are a student, Springpod uses some of your personal and sensitive data, interests, qualifications and skills to suggest suitable opportunities and career paths and help employers target the most suitable students for their organisation. This is explained in a privacy notice which is shown at the first part of communication that details how data will be used for profiling. If you object at this point you will still be able to use Springpod but you will not see suggested opportunities and career paths. Employers will also not be able to target you. You can also object to profiling at any point by contacting the DPO, Sam Hyams, by emailing dpo@springpod.co.uk who will action within 5 working days.

You have the right to ask us not to use your personal data for marketing purposes

We will always inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data. You can also exercise the right at any time by contacting the DPO, Sam Hyams, by emailing dpo@springpod.co.uk who will action within 5 working days.

Our site may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

We may receive information about you if you use any of the other websites we operate or the other services we provide. In this case we will have informed you when we collected that data that it may be shared internally and combined with data collected on this site. We are also working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers) and may receive information about you from them.

6. Accessing our site

6.1. We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period.

6.2. You are responsible for making all arrangements necessary for you to have access to our site.

6.3. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

6.4. Our site is directed to people residing in the United Kingdom. We do not represent that content available on or through our site is appropriate or available in other locations. We may limit the availability of our site or any service or product described on our site to any person or geographic area at any time. If you choose to access our site from outside the United Kingdom, you do so at your own risk.

7. Your account

7.1. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

7.2. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

7.3. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at admin@springpod.co.uk

7.4. You are solely responsible for any information submitted by you to the Site. By using the Site, you represent and warrant that

7.4.1. all registration information, employment information (including responses to work experience or employment advertisements), or any other content you submit is truthful, accurate, up-to-date and not misleading or likely to mislead or deceive;

7.4.2. you will maintain the accuracy of such information (including your email address) and remove or amend it when it is no longer accurate;

7.4.3. where registration is required in order to use the Site you are 13 years of age or older; and

7.4.4. your use of the Site does not violate any applicable law or regulation, in particular , laws relating to discrimination, employment or human rights or other laws.

7.5. Your profile may be deleted and your use of the Site may be terminated without warning, if we believe that you are less than 13 years of age. The paragraph also applies to any content that you submit to other users of the Site, such as prospective employers.

8. Intellectual Property (IP) Rights

8.1. Our IP rights

8.1.1. The Education Hub Group Ltd is the owner or the licensee of all intellectual property rights in our Site, and in the material published on it. The Education Hub Group Ltd has licensed the use of the intellectual property by us. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

8.1.2. You may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.

8.1.3. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

8.1.4. Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.

8.1.5. You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

8.1.6. If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

8.2. Your IP rights

8.2.1. Any content you upload to our site will be considered non-confidential and non- proprietary. You retain all of your ownership rights in your content, but you are required to grant us and other users of the Site a limited licence to use, store and copy that content and to distribute and make it available to third parties. worldwide, transferable, non exclusive, royalty free, and sub licensable right to use, copy, modify, distribute, publish, and process, information and content that you provide through our Site.

8.2.2. We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

8.2.3. You agree that we may access, store and use any information that you provide in accordance with the terms of our privacy policy.

9. No reliance on information

9.1. The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.

9.2. Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied that the content on our site is accurate, complete or up-to-date.

10. Uploading content on our site

10.1. Whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you must comply with the content standards set out in our Acceptable Use Policy. 10.4. We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of our site.

10.5. We have the right, in our sole discretion, to reject or refuse to post any content and to remove any posting you make on our site (including private messages) if, in our opinion, your post does not comply with the content standards set out in our acceptable use policy.

10.6. We may delete, or in pre-authorised areas of the Site refrain from posting any content that in our opinion violates our terms of use or other policies, or threatens the safety of any person. Except to the extent which cannot be excluded or limited by law or regulation in respect of content on the Site which we authorise before posting, we assume no responsibility for monitoring the Site for inappropriate content or conduct. If at any time we choose, in our sole discretion, to monitor the Site, except as required by law or regulation, we nonetheless assume no responsibility for the content (other than our content), no obligation to modify or remove any inappropriate content, and no responsibility for the conduct of the user submitting any such content.

10.9. This clause 10 also applies to any content that you submit to other users including prospective employers.

11. Limitation of our liability

11.1. Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

11.2. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.

11.3. We are not responsible for any incorrect or inaccurate content posted on the Site. We are not liable for any Experience that you may or may not obtain as a result of your use of the Site.

11.4. We assume no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them. When you access these third-party sites, you do so at your own risk. We take no responsibility for third party advertisements which are posted on our Site.

11.5. We are not responsible or liable for the conduct, whether online or offline, of any user of the Site. Under no circumstances shall we be responsible nor liable for any loss or damage resulting from use of the Site, attendance at any Experience organised on the Site’s platform or from any content posted on the Site

11.6. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

11.6.1. use of, or inability to use, our site; or

11.6.2. use of or reliance on any content displayed on our site. If you are a business user, please note that in particular, we will not be liable for:

11.6.3. loss of profits, sales, business, or revenue;

11.6.4. business interruption;

11.6.5. loss of anticipated savings;

11.6.6. loss of business opportunity, goodwill or reputation; or

11.6.7. any indirect or consequential loss or damage.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it.

12. Viruses

12.1. We do not guarantee that our site will be secure or free from bugs or viruses.

12.2. You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software.

12.3. You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of- service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

15. Applicable Law

15.1. These terms and conditions are governed by and interpreted in accordance with English law and you irrevocably agree that the courts of England and Wales will have non exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with the Agreement.
